These terms are an agreement between you and Drivix for the Drivix Rank Tracker. By ticking the box at checkout and subscribing, you accept them. Please read them before you subscribe, and ask us at info@drivix.io if anything is unclear.

1. Who we are and definitions

1.1 "Drivix", "we" and "us" mean Drivix FZ-LLC, licensed by the Ras Al Khaimah Economic Zone (RAKEZ), licence number 17004735, FDCW2101, Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates.

1.2 "You" means the person who subscribes and, if you subscribe for a business, that business. If you subscribe for a business, you confirm you are allowed to accept these terms for it.

1.3 "Service" means the Rank Tracker: the dashboard, scans, maps, reports, emails and related features. "Plan" means the subscription option you choose. "Points" means the monthly allowance of grid points in your plan. "Billing period" means each month of your subscription, starting on the date of your first payment.

2. The service

2.1 The Service checks where a business appears on Google Maps for a search, from each point of a grid around it (3 x 3 to 9 x 9 points), and shows the results on a map, with history and trends.

2.2 One point is one Google Maps check from one location, so a 7 x 7 scan uses 49 points. Your dashboard shows the points used and left.

2.3 Points reset at the start of each paid billing period. Unused points do not carry over and have no cash value. Points used by checks that fail on our side are returned automatically.

2.4 Scheduled scans run automatically. Scans usually finish within minutes but can take longer at busy times. We do not guarantee a time.

2.5 We may improve, change or remove features, provided the Service as a whole keeps its main purpose. If a change significantly reduces what your plan includes, we will tell you in advance and you may cancel.

3. Availability

3.1 We aim to keep the Service available at all times but do not guarantee it will be uninterrupted or error-free. We may pause it for maintenance, security or reasons outside our control.

3.2 The Service relies on third-party providers, including Google Maps and data providers. If a provider changes or withdraws what it supplies, we may need to change the Service. If we can no longer provide the Service, we will end your subscription and refund any unused part of the current billing period.

4. Results and no guarantee

4.1 Results show what Google Maps returned for each point at the time of the check. Google personalises and changes its results, so a person searching from the same place may see a different order.

4.2 The Service measures rankings. It does not change them. We do not promise any ranking, traffic, enquiry or business result, and decisions you make using the Service are your own.

4.3 Map images are provided by Google and are subject to Google's terms. We do not store them.

5. Your account and private link

5.1 You get a private dashboard link by email instead of a password. Treat it like a password: anyone with the link can see and change your tracking.

5.2 You are responsible for activity through your link. If you think someone else has it, email us and we will replace it.

5.3 Give us accurate details, including your billing country, and keep your email address up to date.

6. Price, payment and renewal

6.1 The price and plan are shown before you pay: in AED if your billing address is in the United Arab Emirates, and in USD everywhere else. You pay monthly in advance by card through Stripe, our payment provider. We never see or store your full card number.

6.2 Your subscription renews automatically every month at the then-current price for your plan, and your card is charged at the start of each billing period, until you cancel.

6.3 If a payment fails, Stripe will try again and scans pause until payment is made. If payment is still not made, we may end the subscription.

6.4 Prices do not currently include VAT. If we become required to charge VAT or another tax, we will tell you before it applies, and it will be added to the price.

6.5 We may change prices or allowances with at least 30 days' notice by email. The change applies from your first renewal after the notice period. If you do not agree, you can cancel before then.

6.6 If you dispute a card payment with your bank without first contacting us, we may suspend the Service while the dispute is open.

7. Changing plan, cancelling and refunds

7.1 You can change plan, update your card, download invoices or cancel at any time with "Manage billing" on your dashboard. Plan changes take effect as shown in the billing portal.

7.2 If you cancel, your subscription stays active until the end of the billing period you have paid for, then ends. No further payments are taken.

7.3 Payments are non-refundable, and we do not refund part months or unused points, except where these terms say otherwise or the law requires a refund. If we charge you in error, we will refund the error.

7.4 Nothing in these terms affects rights you have as a consumer under the law where you live, which cannot be excluded.

8. Acceptable use

8.1 You may use the Service for your own business or for businesses you work for. You must not:

• resell, sublicense or share the Service or its data on its own, or give your dashboard link to people outside your business or your clients' businesses;
• access the Service with bots, scripts or scrapers, or try to get around points, limits or security;
• interfere with, overload or reverse engineer the Service;
• use the Service for anything unlawful, or to track businesses in order to harass or harm them;
• use it in a way that breaks Google's terms.

8.2 We may suspend or end a subscription that breaks this section. Where we reasonably can, we will tell you why first and give you a chance to fix it.

9. Ownership

9.1 The Service, our software, design and brand belong to Drivix. These terms give you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active.

9.2 You own the business names and searches you enter. You may use, save and share the reports and maps for your own business and your clients, provided the Google map attribution stays visible.

10. Your information

10.1 We use your details to provide the Service, send scan emails and invoices, handle billing and support, and keep records the law requires, as our [privacy notice](/privacy-policy) explains. We may contact you about the Service and related Drivix services. You can ask us to stop marketing at any time.

10.2 If you end your subscription, your dashboard and history stay available through your link unless you ask us to delete them, subject to records we must keep by law.

11. Liability

11.1 We provide the Service with reasonable care and skill. Apart from that and anything else these terms say, the Service is provided "as is", and we give no other promises, including that it fits a particular purpose.

11.2 We are not liable for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss.

11.3 Our total liability to you under or in connection with these terms is limited to the amount you paid us in the 3 months before the event that caused the claim.

11.4 Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud.

12. Events outside our control

12.1 We are not responsible for delays or failures caused by events outside our reasonable control, such as outages of internet, hosting or data providers, changes by Google, government action, or natural disasters.

13. Ending the agreement

13.1 You can end these terms by cancelling (section 7). We can end them by giving you 30 days' notice by email, and we will refund any unused part of the current billing period.

13.2 We can end them immediately if you seriously or repeatedly break section 8 or do not pay.

13.3 Sections that by their nature should continue after the end, including sections 4, 9, 11 and 15, continue.

14. Changes to these terms

14.1 We may update these terms. We will show the date at the top, and if a change materially affects you, we will email you at least 30 days before it applies to your subscription. If you keep using the Service after that, the new terms apply. If you do not agree, you can cancel before they apply.

15. General

15.1 Notices. We send notices to the email address on your subscription. You can contact us at info@drivix.io.

15.2 Transfer. You may not transfer your subscription without our written consent. We may transfer our rights and obligations to a company that takes over the Service, and will tell you if we do.

15.3 Whole agreement. These terms, the plan details shown at checkout and our privacy notice are the whole agreement between us about the Service.

15.4 Severability. If a court finds part of these terms invalid, the rest stays in force.

15.5 No waiver. If we do not enforce a right straight away, we can still enforce it later.

15.6 Law and courts. These terms are governed by the laws of the Emirate of Ras Al Khaimah and the federal laws of the United Arab Emirates. The courts of Ras Al Khaimah have jurisdiction, unless the law where you live as a consumer gives you the right to bring a claim in your local courts.
